INTRODUCTION
Welcome to brickbears.nl. By accessing or purchasing from this website, you agree to be bound by these Terms of Service (“Terms”). These Terms govern your use of this website and all products and services provided by BrickBears B.V. If you do not agree with these Terms, you must not access or use the Site.

DEFINITIONS
“We”, “our”, and “us” refer to BrickBears B.V. (brickbears.nl).
“You” and “your” refer to the customer, visitor, or user of the Site.

ACCEPTANCE OF TERMS
By visiting our website or making a purchase, you agree to comply with these Terms, including any additional terms, policies, and guidelines incorporated herein by reference. If you do not agree, you may not use our services.

PURCHASES AND PAYMENTS

Payment Methods:
We accept various payment methods as shown at checkout. You must provide valid, accurate payment details. By making a purchase, you authorise brickbears.nl to charge your account for the total amount.

Chargebacks:
Any payment disputes, chargebacks, or reversals will be handled according to the payment provider’s procedures. BrickBears B.V. reserves the right to contest chargebacks by submitting full documentation (shipping proof, tracking numbers, and correspondence). Under Dutch law (Burgerlijk Wetboek Boek 6), fraudulent chargeback claims may result in recovery actions and administrative costs billed to the customer.

Fraudulent Transactions:
Any suspected fraud or unauthorised use of payment methods will be reported to the relevant authorities. BrickBears B.V. reserves the right to suspend or cancel affected orders immediately.

RETURNS AND REFUNDS

Consumer Rights:
In accordance with the Dutch Civil Code (Burgerlijk Wetboek Boek 6, Artikelen 230g–230z) implementing the EU Consumer Rights Directive (2011/83/EU), you have a 14-day statutory “bedenktijd” (cooling-off period) from the day after receiving your goods to cancel your order without giving a reason.

To cancel, you must notify us in writing (email). Items must be unused, in their original packaging, and in resaleable condition.

Refund Policy:
Once your return is received and inspected, refunds will be processed within 14 days. If the item is faulty or not as described, you are entitled to a full refund including return shipping. In other cases, return costs are the customer’s responsibility.

Chargeback Abuse:
We reserve the right to block or terminate accounts that misuse our refund process or initiate chargebacks without legitimate cause.

DELIVERY AND SHIPPING

Shipping Charges:
Shipping fees are displayed at checkout and are the customer’s responsibility unless otherwise specified. We are not liable for delays or damages caused by third-party couriers.

Address Accuracy:
Ensure your shipping address is correct and complete. BrickBears B.V. is not responsible for undelivered packages caused by incorrect address information.

International Deliveries:
If your order is subject to import duties, VAT, or customs fees, these are your responsibility. Check your local customs regulations before ordering.

ACCOUNT AND SECURITY

You may need to create an account to make a purchase. You are responsible for maintaining the confidentiality of your account and password, and for all activities under your account.

Security:
We use SSL encryption to protect your personal and payment information. You are also responsible for securing your own credentials. Notify us immediately if you suspect unauthorised account access.

INTELLECTUAL PROPERTY

All content on brickbears.nl, including text, graphics, logos, and designs, is the intellectual property of BrickBears B.V. You may not copy, reproduce, or distribute any content without prior written consent.

LIMITATION OF LIABILITY

To the maximum extent permitted by Dutch law, BrickBears B.V. shall not be liable for any indirect, incidental, consequential, or punitive damages arising from the use of this Site or products purchased through it. Your sole remedy is to stop using the Site.

Our total liability is limited to the amount paid for the product in question, as allowed under Dutch consumer law.

GOVERNING LAW

These Terms are governed by and construed in accordance with the laws of the Netherlands and EU regulations. Any disputes will be subject to the exclusive jurisdiction of the competent courts of Amsterdam, the Netherlands.

CHANGES TO TERMS

BrickBears B.V. reserves the right to update or modify these Terms at any time. Changes take effect immediately upon publication on this page. It is your responsibility to review these Terms periodically.
